What is Time Wrongfully Spent in Jail Worth? Part 2

Last month, Keffer Hirschauer LLP featured a class action case involving the Whitley County jail and a settlement whereby the parties agreed to pay $43 per hour for every hour that an inmate in the class was improperly detained. The Federal District Court for the North District of Indiana approved a $725,000 settlement that included $317,000 for attorneys’ fees.

Several weeks ago, Carlos Starks settled his lawsuit with the City of Indianapolis, the Indianapolis Department of Public Safety, the Indianapolis Metropolitan Police Department (IMPD), and various IMPD police officers. See 1:12-cv-01008 D.E. 1. Among other claims, Starks asserted that he was falsely arrested and imprisoned. Id. Mr. Starks asserted that he was imprisoned from October 5, 2010, to September 13, 2011. That is, he spent 343 days wrongfully incarcerated.

The parties agreed to settle the case approximately four days before the jury trial was scheduled to begin. The City of Indianapolis agreed to pay Mr. Starks $650,000. That amounts to $1,895.04 per day or approximately $79.00 per hour (including attorneys’ fees). Mr. Starks issued a statement explaining his ordeal: “I survived 11 months in a jail cell away from my family and friends — for no reason at all. Every day I woke up and every day I went to sleep, I was in jail for a murder that I did not commit and did not know anything about.” While he has indicated in an IndyStar article, “Sometimes the Police Are Wrong, Man Settles $650,000 Suit with City” that he has survived and moved on, there is little doubt that the unfortunate incident may stay with him for some time.
