The Rules Committee that is responsible for suggesting changes or corrections to Indiana’s rules of professional responsibility included a pertinent and interesting change to Rule 1.1 of Indiana’s Rules of Profession Conduct.  That rule addresses the competency of a lawyer and states that a lawyer shall provide competent representation, which “requires the legal knowledge, skill, thoroughness and preparation reasonably necessary for the representation.”  Comment 6 of that rule requires a lawyer “[t]o maintain the requisite knowledge and skill, a lawyer should keep abreast of changes in the law and its practice, including the benefits and risks associated with the technology relevant to the lawyer’s practice, engage in continuing study and education and comply with all continuing legal education requirements to which the lawyer is subject.”  If you have a legal need and searching for an attorney to represent you, those inquiries should include questions and discussions about technology and how that lawyer or law firm uses technology when representing clients.
