As of July 1, 2017, individuals younger than 18 will be required to wear helmets when riding an ATV. The sanction is civil in nature, not criminal. An individual could be fined up to $500 for not wearing a helmet. Specifically, the offense is a class C infraction. I.C. 9-18.1-14-11.

The author of the legislation stated that it was intended to get young Hoosiers in the habit of wearing helmets. (last visited July 1, 2017). It has been reported that there were approximately 340 deaths in 2015 related to ATVs. Of those 340 deaths, 58 were individuals younger than sixteen years old.
