Should I Hire a Lawyer for a Traffic Ticket?

Should I Hire a Lawyer for a Traffic Ticket?

You’ve been pulled over by the police, given a traffic ticket, and told glibly by the officer to “have a nice day.” And, while the first inclination might be to take that ticket, crumple it up, and throw it in the trash, anyone who receives a traffic citation should take a moment to carefully consider their next move. Do you bite the bullet and pay the fine, or do you hire an attorney to fight the ticket?

What are the penalties for not paying the ticket? What are the consequences to paying the ticket as it was issued by the officer?

The most common consequence stemming from a judgment for a moving violation is having points assessed on your driver’s license. In Indiana, here are the point assessments for the five (5) most common traffic infractions:

  • Speeding (1-15mph over the limit) = 2 points
  • Speeding (16-25mph over the limit) = 4 points
  • Speeding (26+ mph over the limit) = 6 points
  • Disregarding a Traffic Device = 4 points
  • Failure to Signal Turn = 2 points

A complete list of all traffic citations and their accompanying points can be found in Article 1, Title 140, of the Indiana Administrative Code.

While having points assessed against your license is the most common consequence, you must also consider the collateral consequences that come with a ticket and those points. These consequences could include, but are not limited to, an increase in your automobile insurance costs and even a license suspension. If you hold a Commercial Drivers’ License (or CDL), your employer may look poorly upon a judgment for a moving violation and you could be subject to additional CDL regulations and penalties. If you have a history of traffic violations or offenses, you could become a Habitual Traffic Violator, which can result in a substantial suspension of your driving privileges.

Will hiring an attorney cost more than just paying for the ticket?

While it may seem cheaper and easier to just pay that traffic ticket, speaking to a qualified attorney regarding your moving violation and its potential consequences can be essential in determining the right approach to handling your traffic violation.
