Laws on Magic Mushrooms in Indiana 

According to Indiana Code 35-48-2-4(d)(30), psilocybin (the psychoactive component of magic mushrooms in Indiana) is considered to be a Schedule 1 drug. Per Indiana Code 35-48-4-7, it is illegal to knowingly or intentionally possess psilocybin-containing magic mushrooms in Indiana, as they are considered to be a Schedule 1 drug. • Level 4 Felony: This occurs if the amount is between 5 and 10 grams, or if the amount is 1 to 5 grams with aggravating circumstances. If convicted at this level, a person could face penalties of 2-12 years in prison and fines of up to $10,000.  
• Level 3 Felony: The offense is elevated to a Level 3 felony if the quantity is between 10 and 28 grams, or between 5 and 10 grams with enhancing factors. If convicted at this level, a person could face penalties of 3-16 years in prison and fines of up to $10,000.  
• Level 2 Felony: The most severe charge occurs when the amount of magic mushrooms is at least 28 grams, or if the quantity falls between 10 and 28 grams and there are enhancing circumstances. If convicted at this level, a person could face penalties of 10-30 years in prison and fines of up to $10,000.
